Repeat DUI Offenses And Enhanced Penalties For Felony DUI

In Vermont, a third DUI conviction is a felony with much stronger penalties, and a fourth DUI is a new crime in Vermont that brings even more severe penalties into play. A blood-alcohol content or breath alcohol content (BAC) level of more than .16 in repeat offenses can result in extreme penalties that include:

  • Incarceration: A second DUI can result in up to two years of jail time, and in a felony DUI 3, the jail time increases to up to five years' imprisonment. If you are convicted of DUI 4, you could spend up to 10 years in jail.
  • Fines: For felony DUI, the fines can amount to $2,500 and $5,000 for a DUI 4. Both of these convictions also carry a surcharge of $160.
  • License revocation: DUI 3 and DUI 4 both result in a license suspension. In a DUI 3, there is the potential to reinstate a driver's license after completing a one-year suspension, with ignition interlock required for at least three years. A DUI 4 conviction brings a lifetime license revocation.
  • Other consequences: A felony DUI conviction can result in hundreds of hours of community service, alcohol and driving education program completion, alcohol screening and treatment, increased insurance rates and the immobilization of your vehicle.
